State Plans Appeal After Federal Judge Blocks Texas Abortion Ban

(Austin, TX) — The state plans to appeal a federal judge’s ruling on Wednesday that temporarily blocks enforcement of a Texas law banning most abortions.

U.S. District Judge Robert Pitman of Austin said the law is “flagrantly unconstitutional” and that judges and court clerks in Texas can no longer enforce it.  An hour later, the state notified the court of its plan to appeal to the U.S. 5th Circuit Court of Appeals.

The case could end up before the U.S. Supreme Court, which earlier declined to prevent the law from taking effect on September 1st.
